Registration and Representation Requirements
Foreign suppliers of taxable digital services to Rwandan customers must register for VAT in Rwanda or appoint a local representative with a Rwandan business presence. Domestic suppliers must register and present certification from the state organ regulating public utilities. The tax administration will establish an electronic registration system for VAT compliance.
Digital Services Scope
The legislation covers software programs and updates, search engine services, online gaming, transportation-hailing platforms, user data monetization, online subscriptions, streaming services, web hosting, e-learning programs, and digital marketplace transactions. Services are considered supplied in Rwanda based on recipient location, consumption location, payment method details, or billing addresses.
Collection Mechanisms
Registered suppliers or their representatives collect and remit VAT directly to tax authorities. For unregistered suppliers, financial institutions facilitating payments must withhold and remit VAT. The tax administration provides financial institutions with lists of registered persons exempt from withholding. Payment processors must integrate their systems with tax administration platforms for information exchange.
Tax Point and Compliance
VAT becomes due on the earliest of service delivery, payment receipt, or invoice issuance. Registered persons must file returns and remit tax by the 15th of the month following each tax period. Financial institutions must declare and pay withheld tax by the 15th of the month following the withholding period. Consumers may request VAT refunds within 60 days if payments are returned or consideration reduced.
